DeKalb Superior Court Jurisdiction

DeKalb County Superior Court is Georgia's general-jurisdiction trial court for DeKalb County. Superior Court handles felony prosecutions, divorce and family law, title-to-land matters, equity, major civil disputes, real property issues, and appeals from lower courts. DeKalb County's circuit name also changed. The District Attorney announced that the local judicial circuit name changed effective January 1, 2025, from Stone Mountain Judicial Circuit to DeKalb Judicial Circuit. Older forms, attorney pages, docket references, or archived records may still use the older circuit name, while current local materials use DeKalb Judicial Circuit.

The Northern District of Georgia federal court page appears in the Superior Court image manifest, but federal court is separate from DeKalb Superior Court.

Federal courts may matter for federal cases, bankruptcy, or PACER searches, but DeKalb Superior Court records remain county trial-court records.

DeKalb Superior Family Cases

Divorce and family law are Superior Court matters in DeKalb County. A family case file may include divorce petition, answer, domestic-relations financial affidavit, parenting plan, child support worksheets, temporary orders, settlement agreement, final decree, and post-decree modification or contempt filings. Certified divorce decrees come from the Clerk of Superior Court. Marriage licenses and marriage certificates come from Probate Court, so marriage and divorce should not be routed to the same counter. DeKalb Superior Criminal Civil

The District Attorney is Sherry Boston, and the DA office prosecutes felony offenses filed in Superior Court. 6. For sealed, adoption, juvenile, protected-identifier, or record-restriction issues, expect redactions or a court-order requirement.

PACER is the federal public access system and is shown in the manifest, but it is not the DeKalb Superior Court search portal.

DeKalb Superior Appeals

Appeals from DeKalb trial courts route into Georgia's appellate system, principally the Court of Appeals of Georgia, with some matters going to the Supreme Court of Georgia. The appeal path depends on case type. Superior Court may also hear appeals from lower courts, so a record may have started in State, Magistrate, Probate, or Municipal Court before reaching Superior Court.

For federal cases tied to DeKalb County, the Atlanta Division of the federal trial court for the Northern District of Georgia is separate from DeKalb Superior Court. The federal Atlanta division includes DeKalb County. Federal appeals generally go to the U.S. Court of Appeals for the Eleventh Circuit, except specialized paths such as patent matters.
